Which Act Is More Repugnant?
And today, Trump wants to change the 14th amendment and our laws regarding babies born in the USA are no longer citizens if their parents aren't. 

Pretty ballsy, when a POTUS thinks he can change our Constitution without Congress or a vote.  Imagine if Obama or another Democrat President decided to change the 2nd amendment with the stroke of a pen.


Anyone not believe the Constitution isn't under attack by Trump yet?  Still not worried?  You cool with Presidents changing our Constitution for any parts they don't like?  Last time I checked that's the shit dictators do.   So much for being gung-ho about taking an oath to defend the Constitution.... Trump is wiping his ass with it today.

Trump is not changing the Constitution.  

He is (potentially) using any Executive branch power he has to effect policy.  Just as Obama did during the enactment of the DACA & DAFA policies.  
The Constitution grants wide berth and plenary power to the Executive concerning immigration enforcement.  

The 14th amendment was a Reconstruction era amendment to ameliorate the Dred Scott SCOTUS decision and make slaves/descendants full citizens. 
It reads:  " Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

On the bolded clause above, there is much Constitutional scholar debate on whether illegal aliens are subject to jurisdiction...you know...since they're ILLEGAL ALIENS from another country.  
So maybe we might refer to one of the Amendments Senate co-founders...Sen Jacob Howard from Michigan....
At the time of passage, he said: "This (14th Amendment) will NOT, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors
                                                   or foreign ministers accredited to the Government of the United States." 

Therefore... the 14th Amendment has ALWAYS been clear, that Anchor Babies were never considered to have citizenship, by birth. 

That politicians never had the courage to properly ENFORCE the 14th Amendment.... isn't Trump's fault.  
I believe part of your issue here, SFVikeFan... is you're used to non-enforcement of immigration laws (by politicians from BOTH sides)...becoming de-facto 'law'.  
At least, de-facto practice.  Just because illegal alien Anchor Babies have been tacitly admitted, doesn't make the case they're Constitutionally protected.  

However... I think Trump has a much more of a 'Constitutional leg', to stand on... when you consider the history of the 14th Amendment and the arguments made by it's co-founders.

Say what you want Savannah, the 14th amendment is pretty damn clear on citizenship.  It's black & white.  There's no wiggle room for interpretation.  If you're born here, you are a US citizen.  PERIOD.  An EO doesn't get to re-interpret a Constitutional amendment.   Even Paul Ryan agrees:  You cannot end birthright citizenship with an executive order,” Ryan said in a radio interview on Tuesday afternoon.

You want to reverse or change a Constitutional amendment, it's 2/3 vote by Congress and ratified by 38 states.  If you think ANY President gets to re-interpret ANY Constitutional amendments, you're setting an extremely dangerous precedent and opening a huge can of worms that doesn't go away after he's gone.  I'm a gun-owner, but if we're going to give a POTUS such a broad stroke to write EO's that override the Constitution ... it will open the door for a Democrat President to take a hard look at the outdated "need for a well regulated militia" and toss the 2nd in the dumpster.  I bet you might have something to say about that though.

GOP is allowing Trump to shit on the Constitution and wipe his ass with it, just to stoke more fear and division amongst his base against brown people.  This EO will get tossed by the courts, but I'm shocked at his brazen attempt to incite more fear right before midterms ... didn't think he'd stoop so low as to attack the Constitution.  And yet ... not a peep from the GOP.  


I thought Republicans were staunch Constitutionalists ... what happened?   Dictatorship more appealing when it's your guy doing the yelling and trying to throw guaranteed  laws & rights in the trash?
