This is barely, and I mean barely, over the limit. 

"[Ben Goessling] The Minnesota State Patrol stopped Phillips on Interstate-394 In Minneapolis around 9:45 last night for speeding. He tested at a blood-alcohol level of 0.10, which is above the Minnesota legal limit of 0.08. Phillips has a court appearance scheduled for Dec. 21 in Hennepin County."

Just so everyone understands, I don't drink and drive anymore. My wife and I Uber if we are going out and drink. We both stopped about 10 years ago because its the right thing to do. Doesn't matter if the bar/restaurant is 4 miles away, we just don't do it, we'll Uber/Lyft. Never had any DUIs or close calls or anything but we don't want to hurt/kill anyone. I say that because I'm going to say .10 isn't even buzzed. Or just barely noticeable. And some of you might say that's bullshit, you shouldn't drink at all and drive, etc. Totally fine response. But have one glass of red wine and you are going to be close to .08. 2 full bodied IPAs will get you damn close or over as well. I'd wager this was no more than 2 cocktails/drinks, maybe less. He's 0.02% away from being legal. Its an infinitesimal amount.

Even the woman that founded MADD has come out and stated that the .08 level is absurd.  I'm not defending him breaking the law,  just saying that the law may be overly aggressive.  .1 maybe was a better benchmark for most,  but think of all the money the legal system has made from pleading down the charges from these close cases,  which I s what will likely end up happening here.

I don't know what to think anymore. I looked up how many drinks it takes to blow .08. It surprises me how many drinks you can actually have before you're over the limit. Some surprising numbers if they're accurate...

Two beers in an hour for a 150 pound male is estimated to give him a blood alcohol content of .0395. At 200 pounds while consuming the same amount of beer in the same amount of time, a male’s estimated blood alcohol content would be around .0266. Although impairment has started, that 200 pound male would be well below the legal limit. According to the NHTSA calculator, he can legally consume a third beer and still drive under the .08 legal limit. Six beers in two hours would put him over that legal limit though.

Really? I'm 6-2, 200 lbs. You're telling me I can drink 5 beers during a movie and be fine to drive?

Yeah, it can be confusing. Its about the alcohol content of the beverage. A glass of wine is usually between 11%-13%. Lite beer is 4%. Stuff like Trulys is 5%. A good IPA can go from 6%-9% alcohol. Some of the really strong beers can go up to like 12-14% but you can really taste it, lol. They are strong. Near beer at the stadium is like 3.2% or something ridiculous like that? Piss water.

Yeah, I volunteered at the Great American Beer Festival one year, working a table of samples. We were allowed to consume, encouraged actually. My table had a barley wine that was 11% ABV. My friends and I were not aware of this fact when we were dancing behind the table pissed as farts.

The key word that is not being emphasized here is that it is driving under the Influence, not driving drunk.  The fact is that anything around that level can potentially affect your reflexes and attention to some degree and that degree that does not take much and that is why the law is there.  Go tell the parents who lives have been changed forever by someone who felt like a few beers didn't affect them about how .08 is too low.  It's pretty simple, if you are going to drink more than one of anything don't drive, in this day of Uber and Lyft there is no reason to take that chance.

The woman who started MADD lost a child IIRC,   

Fact is driving while  eating, texting, driving with children or pets and many other common things are as likely or even more likely to cause the same issues and are far more common occuramces.  Maybe its time for people to focus their rage towards the bigger problems?  Not saying DUI isn't a concern,   but there are some damn big hypocrites out there condemning one while doing something worse themselves.  How about those whose vision or reflexes have declined to the point where they shouldn't be driving.... they cause a lot of accidents
..maybe we should talk about mandatory testing for the elderly at more frequent rates?

I spend a lot of time on the road for work and personal,   honestly somebody driving after a couple 3 beers concerns me much less than a lot of others falling into these other categories.
