Vaccine Mandate, Vikings and USB Stadium questions

I want to ask everyone to not make this political.  Keep it strictly Vikings and USB related.  There are plenty of other threads that have the covid debate and more then enough mud slinging. 

Couple questions:

With Biden's 100 person organizations I'd assume that would include all NFL teams?  I'd think it would include all stadium employees?  Both groups would certainly have north of 100 employees right?  The end around on both of these would be weekly testing for unvaccinated.  Until this is taken another step forward and just flat out required. 

Buried in his remarks Biden said:  Biden also called for COVID-19- vaccines to be required to attend sports
arenas, large concert halls and other venues where large groups of
people gather. Yet he did not single out
outdoor football games.
I can't find anything that says there was an EO actually mandating this?  But, if true wouldn't that require all attendees including people on the field?

See, lets leave that out of this.  We've all made our cases well known for or against Kirk.
This is really just a question on whether I'm reading more into Biden's remarks or if there is actually going to be teeth to this?

I guess a fascinating angle would be....
Lets say Biden does in fact have an EO that requires attendees of a sporting event to have been vaccinated.

Hypothetically if it came into effect on say 10-1-21 and Kirk didn't get vaccinated what would that mean for the season, our salary cap, frankly everything Viking related.  Could the Vikings get out of his deal or would he just go on IR? 

Lots of interesting conversations to be had.

There is still a lot of ambiguity around how Biden's mandates will take shape, but based on what is out there today, I would say that as an organization, the Vikings will either have to require vaccination of all employees or do weekly testing.  This is not really a choice when it comes to players -- mandating vaccination would likely violate the CBA and players are already meeting the testing requirement.  So no impact on them from that perspective.  The sporting event (concerts, etc.) language would appear to apply to attendees and not to the performers.  So based on what I have seen, the Biden mandates will have no impact on the Viking players.

Does he have the ability to issue executive orders that would
issue requirements to private venues without it being overturned in the courts?  I know there’s a strong history of congress
giving the president tons of power in emergencies, but I don’t know the exact powers
they’ve given them.

iirc unvaccinated player are already tested daily,  so the nfl is already going above and beyond the order.

The government already controls a lot of safety aspects of the structure of buildings.  All the way from housing permits to massive venues.  Can they use OSHA safety standards for employees?  Probably??  OSHA is one of those letter agencies you DO NOT F with.

but yet no establishment was ever shut down by osha for allowing smoking indoors due to the health risk to the employees,  yet that was the #1 reason for the smoking bans in bars and restaurants.  IMO they would have a hard time with this one since there is a working vaccine available to all in this country and although its not a complete avoidance of the disease,  most vaccinated will have little to no issues if they do catch it.  I think this would then lead to mandatory flu vaccinations as well as a whole slew of other govt over reaches.

Interesting on the smoking angle.  Probably comparable and if you were a lawyer you could certainly use it as precedent either way. 

.gov has been over reaching for decades.  This is going to be highly contested and certainly will have an impact going forward. 

I know Obama used the DOL to rewrite our business.  He essentially wanted to make compensation in financial products illegal.  I now have a 30 page form I have to give out to clients every time we meet stating some pretty obvious things.  Obama's crew wrote the EO, Trump's crew neutered it.  The industry policing itself basically just followed the lions share of what Obama wanted and now we're here. 

All that to say, going through letter agencies to get what you want is something thats been done before.
